Mercari, Inc., Merpay, Inc., and Mercari Software Technologies India Private Limited (collectively with all other subsidiaries in Japan and India, “Mercari Group”, “we”, ”us”, or “our”) are committed to protecting the personal information of users collected through this Website (including our online platform or our associated mobile application) –  pursuant to the Privacy Policy (“Policy”) set out below. 

Unless indicated otherwise, this Policy further applies to any related websites or other online properties owned or controlled by the Mercari Group. By submitting this personal information, the user (“you”, or “your”) consents to the use and disclosure of the information in accordance with the Policy. 

Please note that links from our Website may take you to external websites which are not covered by this policy. We will not be responsible for the content, function, or information collection policies of these external websites.

1. Collection of Personal Information

Personal information means any information that pertains to a natural person, which, either directly or indirectly, aids in uniquely identifying that person and distinguishes such person from other persons. 

We usually collect personal information as required under laws and regulations when you: (a) visit our Website, (b) give us your business card, (c) enter your data on our Website, or (d) subscribe to receive updates, newsletters, and other publications from us for informational purposes. Mercari Group collects user’s personal information, including the following:

  • name, age, address, date of birth, phone number, email address, educational background, professional background, certifications, current income, expected income, and other personal and professional information.;
  • any information included in documents the user provides to Mercari Group when applying to recruitment activities, including but not limited to resume, curriculum vitae, application form, or survey.;
  • any communication between Mercari Group and the user in any form, such as face-to-face, email, or phone calls.;
  • any information Mercari Group collects during screening procedures such as background checks and reference checks in the candidate screening process.; 
  • the user’s history of application to and participation in recruiting or allied activities, as well as screening results.;
  • technical information, including the Internet Protocol address, your login information, browser information, time zone information, operating system information, versions of plug-in installed, and platform.; and
  • information about the user’s visit to the website, the Uniform Resource Locators’ information, and information relating to the user’s interaction with the Website.

The personal information collected by Mercari Group may include information related to a user’s gender, health, nationality, etc. (collectively, “sensitive information”) according to our contractual arrangements with the user. The provision of sensitive information will be governed by specific terms of such contracts (including collection and processing of such data or information) and not this Privacy Policy.

2. Usage of Personal Information Provided

Mercari Group will use the information provided by you (including a visitor) or otherwise obtained by us for – (a) developing new services on the Website or otherwise; (b) improving the existing services on the Website or otherwise; (c) providing updates, newsletters, and other publications (including promotions) to you for informational and/ or marketing purposes; and/ or (d) complying with our legal obligations. We shall process and analyze the information based on your consent, the performance of a contract, compliance with a legal obligation, and legitimate interest. 

Mercari Group also uses the personal information collected from users for recruiting activities. This information is used for:

  • evaluating the qualifications of applicants/ users in recruitment screenings at Mercari Group (including background checks, reference checks, and any other screening procedures).;
  • improving Mercari Group’s recruitment processes, including enhancement of diversity in recruitment.;
  • ensuring the suitability of work (assignments, etc.) and health in Mercari Group.;
  • supporting applicants/ users in obtaining necessary visas and/or work permits.;
  • providing information to applicants/ users regarding employment opportunities, events, etc. by Mercari Group.;
  • improving Mercari Group’s employment opportunities, events, etc., and measuring satisfaction.;
  • contacting applicants/ users regarding recruitment activities.;
  • managing information about applicants/ users/ visitors.; and/ or
  • other purposes incident to recruitment activities, such as calculating statistics for use in future hiring plans.

3. Provision of Personal Information to a Third Party

Unless required by the applicable law, Mercari Group will not provide any personal information of a user to third parties, except if:

  • you have consented to us sharing your personal information with third parties.;
  • we are under the legal, regulatory and professional obligation to do so to comply with the applicable laws.;
  • third parties service provider(s) are engaged by us for processing your personal information.;
  • it is necessary to protect a human life, body, or fortune, and when it is difficult to obtain the user’s consent.; or
  • it is particularly necessary to enhance public health, and when it is difficult to obtain the user’s consent.

4. Entrusting Information to a Third Party to Handle Personal Information

Mercari Group may entrust all or some of the handling of personal information to a subcontracted third party that meets the selection standards defined by Mercari Group and execute a contract with the third party ensuring that all personal information will be suitably managed. 

The subcontracted third parties may include third parties in foreign countries including overseas cloud service providers. In this case, Mercari Group may provide personal information only to the extent necessary to carry out the subcontracted work.

5.Joint Use of Personal Information

We jointly use the collected personal information between companies in the Mercari Group.

6. Management and Security of Personal Information

Mercari Group securely stores personal information collected from users in servers in an environment inaccessible to the general public and strives to prevent unauthorized access, loss, destruction, alteration, or leakage of data. All Personal Information gathered on our Website is securely stored within the Mercari Group’s database.      

We follow industry best practices to prevent the loss, misuse, or alteration of your Personal Information, including when storing or transmitting all your Personal Information. By agreeing to this Policy and using the Website, you acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet. You are responsible for keeping the password you use for accessing the Website confidential; we will never ask you to send us your password (except for the standard login procedure on the website). Notwithstanding anything contained in this Policy or elsewhere, we shall not be held responsible for any loss, damage, or misuse of your Personal Information.

In the event that recruitment screening results in an applicant/ user joining the company, Mercari Group treats the personal information collected from that applicant/ user as employee information, and stores and manages the applicant’s personal information in accordance with Mercari Group’s internal regulations. In the event that an applicant/ user does not join us, Mercari Group stores the applicant’s/ user’s personal information for a certain period to the extent necessary for improving our recruitment processes, providing information to applicants/ users regarding employment opportunities and events being conducted by Mercari Group, etc.

7. Retention period

We will keep your Personal Information for as long as reasonably necessary to fulfil the purposes that we collected it for. However, we take steps to regularly review our information to ensure that we are not holding excessive Personal Information for longer than is necessary or required.

8. Disclosure, Correction, and Suspension of Use of Personal Information

If a user requests that their personal information be disclosed (including disclosure of records stating to which third parties their data has been shared), edited, added to, deleted, erased, or that its use or provision to third parties be suspended, Mercari Group will respond to that request appropriately in accordance with relevant laws and regulations. If a user wishes to correct any personal information that they sent to Mercari Group using the registration form (if filled), they may do so by re-sending the registration form with the corrected personal information.

To research and analyze the usage status, etc. of the Service, the Group uses Google Analytics (a service provided by Google LLC) on the Service. Mercari Group strives to improve this Policy appropriately. This Policy may be updated to reflect changes in laws and regulations, the necessity of recruitment activities, services, etc.

This Policy is applicable to Mercari Software Technologies India Private Limited. If you choose to visit the Website, your visit and any dispute over privacy are subject to this Policy and the Website’s terms of use. In addition to the foregoing, any disputes arising under this Policy shall be governed by the laws of India.
